Constitution Assignment

 

 

I didn’t want to put my constitution assignment here because it is quite old but I thought, why not?

It says about Fourteenth Amendment of the Constitution Act, which is mostly known as the right to life of the unborn. 

Fourteenth Amendment of the Constitution Act, 23 December 1992

[Provided that Article 40.3.3°( the right to life of the unborn) would not limit freedom to obtain or make available information relating to services lawfully available in another state.]

Amendment

An amendment is a formal or official change made to a law, contract, constitution, or other legal document. It is based on the verb to amend, which means to change. Amendments can add, remove, or update parts of these agreements. They are often used when it is better to change the document than to write a new one.

What does it mean?

This means that every woman living in Ireland has the right and unrestricted access to information about abortion in other countries.

Overview

  • 1992 ‘The X Case’

 

  • A  14-year-old girl had been raped by a neighbor and became pregnant. At that time abortion was illegal in Ireland so family traveled to England for an abortion.

 

  • As a result oh ‘The X Case’ there were 3 constitutional amendments proposed. These amendments were put to the people on 25th November 1992.

 

  • The Twelfth Amendment was a failed proposal to amend the Constitution of Ireland, to state that abortion would be allowed in some limited circumstances.

 

  • The Thirteenth Amendment of the Constitution of Ireland specified that the prohibition of abortion would not limit freedom of travel in and out of the state.

 

  • The Fourteenth Amendment of the Constitution of Ireland specified that  the prohibition of abortion would not limit the right to distribute information about abortion services in foreign countries.

2 ‘Yes’ 1 ‘No’

There were three referendums in 1992. All of them  were rejected on the 25th November 1992 but only two of them were successful.

The Twelfth Amendment was a failed referendum.

 The Thirteenth Amendment of the Constitution Act, 1992, which was approved by referendum on 25 November 1992 and signed into law on the 23 December of the same year.

The Fourteenth Amendment of the Constitution Act, 1992, which was approved by referendum on 25 November 1992 and signed into law on the 23 December of the same year.

Changes to the text

Insertion of a new paragraph in Article 40.3.3º

‘’This subsection shall not limit freedom to obtain or make available, in the State, subject to such conditions as may be laid down by law, information relating to services lawfully available in another state.’’
